This Security contract entered into this between
Having its head office at
(Hereinafter referred to as the "Institute" of ONE PART)
And
Boss Security & Services , 3rd Floor Ravi Chambers, Sharanpur Road, Canada Corner Nashik-422002 (Herein after Referred as the "Agency" of the OTHER PART)
Whereas the Institute is carrying out the Educational Activity from its premises At
And whereas the Agency is in the Business of providing the services in security to the various Institutes & Industrial premises in Nashik And Other Locations.
And whereas the Agency should provide security services to the
(Hereafter referred to as the premises). And the Agency has offered its services at the premises.
NOW IT IS AGREED BETWEEN THE PARTIES HERE TO AS HEREUNDER.
1. This Agreement shall be in force for a period of one year, with effect from 01/12/2014 unless expressly renewed, the agreement shall automatically lapse on expiry of one year and shall be renewable by mutual consent for a further period or periods on the terms & conditions agreed upon, provided however, that either of the parties shall be at liberty to terminate this agreement during the period by giving one month notice to the other party.
2. That the Agency has made a full survey of the Institute and the Security services requirement of the said premises of the Institute to safeguard all the assets, materials and properties at the said premises of the Institute, by posting properly qualified and trained Security guards & Supervisors, in required numbers.
3. The Agency agrees to perform the work of guarding Institute premises and also agreed to do all incidental work such as attendance, inward & outward, parking & monitoring etc.
4. In case of any loss or damage causes due to negligence of the agency's employee while performing their job, the cost of such damage shall be deducted from the amount payable to the agency, would be at discretion of the Institute.
5. The Agency shall be fully responsible for any theft in the foresaid premises during the tenure of this agreement and shall carry out its investigation into any untoward incidence occurred in the said premises of the Institute, and report to the Institute, within reasonable time, of its finding of the said investigation. The Agency agrees to compensate to the Institute for the loss or damage to the colleges / school properties due to negligence of the employees employed by the Agency.
6. The Agency agrees that it shall hold itself responsible for any accident injures to its employees sustained by the Institute premises, or outside, in the course of their duties and that the agency shall obey to all regulations in respect of such happenings by reporting to proper authorities about the accident and treatment at its own expenses,.
7. The Agency agrees that in case if the Institute is of the opinion that security personnel do not have necessary qualification and level of experience or individual performance of the security guards is not satisfactory, the Institute reserves the right to ask agency any change such as personnel without assigning any reason whatsoever. The Agency shall, as its own cost, obtain all permits and licenses under any law or regulations in connection with rendering of services to the Institute under this agreement.
8. The Agency to provides 5 (Five) number of security personnel required (in urgency or as per requirement) to maintain the security round the clock of the said premises of the Institute , the shift timings would be as mentioned below and in case of any agency employee is absent or not working due to any reason the agency shall arrange replacement. If required, for example in case of sickness/absenteeism arising out for longer duration or any other reason & Institute will not pay extra duty hrs salary to agency.
9. The Agency agrees to provide uniform & other facility to its employee at its own cost. The proper uniform raincoats/Umbrellas, torchlight & other items required by them for maintaining the security of the Institute property will be provided by the Agency.
10. The Agency agrees to conduct a surprise check on the security personnel recordings & other works on duty.
11. The Institute, on request and at the instance of the Agency, has provided employee engaged by the agency, for duty at the premises of the Institute, use during their duty hours, of drinking water, using toilet and washing facilities available in the said premises of the Institute.
12. As per requirement of the Institute the agency has agreed to provide the necessary security force and the Institute agrees to pay to the agency. In consideration of the services rendered by the agency for 12hrs (Including all applicable charges) as per detailed below:
13. The Institute herewith provides for followings responsibilities & duties to be performed by the agency.
a) Overall, responsibilities for the safety & security of the said premises round the clock.
b) To Co-ordinate and supervise the safe working of the Institute.
c) To ensure that there is no theft, fire and other hazards which may lead to financial losses to Institute.
d) To patrol round the Institute on routine intervals and give written reports of any untoward incident noticed.
e) To maintain security personnel muster register and wage payment records, get the same duly signed by the authorized officer of the Institute.
f) To maintain the gate pass and other documents as the Institute provided to maintain form time to time.
g) Maintain register for incoming and outgoing material, visitors registers, visitors pass file, Student attendance IN & OUT only as per schedule provided by college and no outsider or student is allowed inside the Institute (colleges / School) premises with proper authorization from Institute (colleges / School); Keys to all gates and any other register of files as the company may insist to all maintain form time to time.
h) Prevent unauthorized entry of any person or any vehicle inside the premises of the Institute.
i) To Liaison with the Police, Fire brigade, Electric & Water supply agencies and or any other agencies, to ensure maintenance of essential services required by the Institute, and smooth and peaceful operations of the Institute.
j) Any other tasks assigned from time to time.
14. The Agency agrees to perform the duties as here in above referred.
15. In the event of any disputes or differences arising between the parties hereto, they shall be referred to two arbitrators; one to be appointed by each party and such reference shall be deemed to be reference to arbitrary Act. 1940 and the proceedings will take place in Nashik.
16. Payment made by the Institute on or before 10th of every month by cheque.
17.Any changes of alteration in this agreement shall not affect unless in writing
and signed by both the parties hereto subscribed.
In Witnessed the parties hereby mutually agree to the above terms and conditions. And have hereunder sealed on the date mentioned under their signature.
